Community Asset Transfer Requests
Part 5 of the Community Empowerment (Scotland) Act 2015 enables community bodies to make requests for any land or buildings they feel they could make better use of. Community bodies can request ownership, lease or other rights as they wish. The Act requires that the Council assesses each request transparently against a specified list of criteria and agrees to the request unless there are reasonable grounds for refusal.
Requests which directly affect Council services will be particularly challenging especially if the Councils objectives or statutory obligations will be adversely affected, or where the cost of continuing to deliver the affected service will increase. The Council is keen to explore co-operative benefits in closer working relationships with community bodies in advance of a formal request being submitted. Community bodies are encouraged to discuss their ideas with the Council at an early stage. An Expression of Interest Form is available from the 'Related Downloads' section of this page.
On receipt of a valid application the Council will aim to make a decision within six months. Detailed information about each request will be published in accordance with the requirements of the Act, with personal and confidential information concealed as required.
