The Orkney Islands Council (Orktoberfest streets in Stromness) (Temporary Closure) Order 2023

Orkney Islands Council (hereinafter referred to as “the Council”) in exercise of its powers under Section 62 of the Roads (Scotland) Act 1984 (“the 1984 Act”) and of all other enabling powers, hereby makes the following Order:

1. The provisions of Articles 4 and 5 of this Order shall apply to a length or lengths of road only where so indicated by the display of signs as prescribed by the Traffic Signs Regulations and General Directions 2016.
2. For the duration of this Order, no person shall drive or cause or permit to be driven any vehicle on the roads specified in the Schedule to this Order, if a traffic sign has been erected to indicate that the length of road is closed to traffic.
3. The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.
4. This Order may be cited as The Orkney Islands Council (Orktoberfest Streets in Stromness) (Temporary Closure) Order 2023 and shall be in operation on Saturday 21 October 2023 between 15:30 and 19:30.
5. The Council is satisfied that, for preventing the likelihood of danger arising to persons or other traffic using the lengths of road specified in this Order, it is requisite that Section 3(1) of the 1984 Act should not apply to this Order.
6. For the duration of this Order, no person shall permit any vehicle to wait at any time on the roads specified in the Schedule to this Order, if a traffic sign has been erected to indicate that the length of road is closed to traffic.
7. Nothing in Articles 4 or 5 of this Order shall apply to any authorised vehicle being used in connection with the holding of a procession from the Pierhead in Stromness to the Stromness camp as part of Orktoberfest.
